Project Delays – Maha Police Files FIR Against Pune Builder

A day after the Maharashtra Police issued a circular instructing the police to consider FIRs against developer related complaints as criminal offences and take action accordingly, Pune police on Tuesday (July 5), filed an FIR against a builder for not executing a conveyance deed.

Acting on a complaint filed by a RTI Activist, Pune rural police used sections of the Maharashtra Ownership Flats (Regulation of promotion of construction, sale, management, and transfer) Act (MOFA) and Maharashtra Regional Town Planning Act against the builder.

The complaint also stated that the Mahavir Barlota carried out construction beyond sanctioned plan, did not provide the promised facilities like a garden, a playground, and a gym. We have initiated an inquiry and sought for the plans of the complex from municipal authorities.

Complaints mainly pertain to builders who cheat flat buyers, violate building norms, failing to complete projects on time and handing over possession to flat purchasers without procuring the mandatory building occupation certificate. It also mentioned builders who build beyond the sanctioned plans or those who build illegally.

In response to it, Mahavir Barlota alleged that flat owners failed to provide documents for conveyance deeds. Furthermore, he told that he had transferred bank accounts needed for the society and will provide the deeds to society in three months. He told that he will cooperate with the police as needed.

Pune officials revealed that investigations for the case are underway and they haven’t arrested the developer yet.
