MahaRERA has issued significant judgments regarding possession delays in Maharashtra’s real estate projects. Key cases include:
- Imperia Homes: In 2019, MahaRERA fined a Pune developer Rs. 1 lakh daily for project possession delays, also ordering compensation for homebuyers.
- Unique Shanti Developers: In 2018, MahaRERA instructed a Mumbai developer to refund money with interest and compensation due to possession delays.
- Lodha Developers: In 2017, MahaRERA mandated refunds with interest and compensation for possession delays in a Thane project.
- Avinash Saraf Vs. Runwal Homes Pvt. Ltd (2016): Despite the builder’s claim of pre-RERA agreement, the court ruled RERA’s retrospective application, holding the developer liable for compensation and interest on registration and stamp duty.
