The Pune city police have booked the proprietor of M/s Royal Builders for delaying giving possession of a flat and failure to offer the promised amenities in a Kondhwa-based project to a senior citizen.
Nilofar Yusuf Sayeed (60), a widow, lodged an FIR at Kondhwa police station against Aliasgar Ismail Icecreamwala, the owner of M/s Royal Builders.
Speaking to Pune Times Mirror, Nilofar recalls, “In 2019, my husband had booked a flat for Rs 47 lakh in the Royal Sublines project. He was promised possession of it early in 2023. In 2021, I lost him to the pandemic, and our dream to stay together in the house remained such.
“The builder was delaying giving possession of the flat. Despite multiple complaints to resolve the matter, the police did not take any action against the builder. I was left with no option but to knock on the door of the court.”
Nilofar knocked on the door of the court of Judicial Magistrate (First Class) AA Kulkarni in Cantonment. Her advocate Tosif Shaikh moved a private complaint before the magistrate and on March 7 the court directed the Kondhwa police to investigate the case under the provision of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Considering the grievance and the failure of the police to act, the court directed the registration of an FIR. As a result, the FIR was registered against Aliasgar Builder on March 22 at Kondhwa police station.
A police officer, who spoke to Pune Times Mirror on condition of anonymity, said, “We are probing the case and soon shall arrest the builder.”
Advocate Shaikh said, “This action marks a significant step in ensuring accountability for builders who fail to meet their contractual obligations, causing undue hardship to homebuyers.”
