Landmark Judgment Upholds Home Buyer’s Rights in Real Estate Dispute
In a notable legal development, Justice Sandeep V. Marne delivered a recent ruling on February 26, 2024, affirming the rights of homebuyers in a real estate dispute involving Wadhwa Group Housing Private Ltd. and Mr. Vijay Choksi concerning the “The Nest” project in Mumbai.
The case centered on Mr. Choksi’s request for a refund of the payment made for a 3BHK flat in “The Nest,” citing alleged violations of the Maharashtra Ownership of Flats Act (MOFA) and the Real Estate (Regulation and Development) Act, 2016 (RERA). Previously, the Maharashtra Real Estate Appellate Tribunal had directed both the developer and respondent to refund the entire amount with interest, a decision contested by Wadhwa Group Housing Private Ltd. in the appeal.
The central issue was whether a developer, having not received any consideration from the allottee, could be obligated to refund the amount under Section 18 of RERA. Additionally, the appeal questioned the necessity of a remand order due to the Tribunal’s omission on the developer’s refund liability.
Justice Marne’s ruling dismissed the Second Appeal filed by Wadhwa Group Housing Private Ltd., affirming the Tribunal’s directive for both parties to refund Mr. Choksi’s entire payment with interest. The interest rate was determined as the State Bank of India’s Highest Marginal Cost of Lending rate plus 2%, calculated from the payment dates to the actual realization date. Additionally, Mr. Choksi was awarded costs totaling Rs. 20,000.
